Hire Payments

Payable on the 1st day of each consecutive month (and when such day is not a Business Day, (being any day other than a Saturday or Sunday or public holiday in England), on the next immediately following Business Day), the first payment being due on the 1st

Period of Hire:

The Goods shall, subject to clause 10 of the terms and conditions below, be on hire for the Minimum Period of Hire. The minimum period of hire shall be one month commencing on and from the date of this Agreement, (“the Minimum Period of Hire”) and thereafter this agreement shall continue from month to month until terminated in accordance with the provisions of this agreement. Please see clause 3 and clause 10 of the terms and conditions below.            

 Key Information 

1. The following default charges are payable:-

a. The Owner’s reasonable legal and professional fees if the Owner is required to enforce any term of this Agreement and/or as a result of the Hirer failing to pay any amount due under this Agreement and/or the Owner’s cost and expenses to recover the Bike from the Hirer following the termination or expiry of this Agreement  

2. This Agreement is cancellable.

MISSING PAYMENTS

Missing payments could have severe consequences and make obtaining credit more difficult.             

IMPORTANT - READ THIS CAREFULLY TO FIND OUT ABOUT YOUR RIGHTS

The Consumer Credit Act 1974 lays down certain requirements for your protection which should have been complied with when this agreement was made. If they were not, the owner cannot enforce this agreement without getting a court order.

The Act also gives you a number of rights. You can end this agreement by writing to the person you make your payments to and giving at least one month’s notice. In order to do this the agreement must have been allowed to run for at least 18 months though this may include the period of notice. You will have to make all payments and pay any amounts you owe until the date the agreement comes to any end.

YOUR RIGHT TO CANCEL

Once you have signed this agreement you have a short time in which you can cancel it. Details of how to cancel it will be sent to you by the owner.

Terms and Conditions

Definitions:-

Bike: means the Bike described in the Key Financial Information section.

Business Day: means as defined in the Key Financial Information section.

Any reference in these terms and conditions to “You” or “Your” is a reference to the Hirer(s) as detailed above, and any reference to “We” or “Us” or “Our” is a reference to the Owner as detailed above.

1. We let to You, and You agree to take on hire from Us, the Bike on the terms of this Agreement.

2. The Bike is Our property at all times. You need to keep the Bike in Your possession other than for maintenance or when You return it to Us. You cannot sell or otherwise transfer the Bike.

3. Providing that You continue to pay Us on time and You don’t become insolvent (see clause 10) You are hiring the Bike for at least one month from the date of this Agreement and this will continue monthly until either You or We give a month’s written notice to the other, to end the Agreement.

4. You need to pay all Hire payments (which are inclusive of VAT) and other payments to Us when they are due; if You don’t You will be in breach of this Agreement.

5. You are responsible for keeping the Bike in working order, which includes the costs of maintenance. You are also responsible if the Bike is lost or stolen or if damaged beyond repair even if it wasn’t Your fault. This is all with the understanding on Our part that the Bikes are for riding so We expect fair wear and tear and a few scratches from crashes.

6. If anything bad happens to the Bike; if You no longer are in possession of it or the Bike becomes unfit for purpose and unrepairable You must contact Us by email at academy@hopetech.com within 5 Business Days. If the Bike can be repaired We will organise repair or replacement of relevant parts within a reasonable time, You will be charged for labour.

7. We recommend that You keep the Bike fully insured, this is at Your expense.

8. As it says in Clause 6, if the Bike is lost, stolen or damaged beyond repair You must email Us at academy@hopetech.com as soon as possible.

9. If the Bike is lost or damaged this Agreement continues, until terminated in accordance with this Agreement.

10. You shall be in default of and be deemed to have repudiated this Agreement if You (or any of You if more that one):

10.1 Breach any of the terms of this Agreement; or

10.2 Present or allow to be presented a bankruptcy petition within the meaning of the Insolvency Act 1986 or any statutory modification or re-enactment of that Act;

10.3 Suffer a bankruptcy petition to be presented against the You; or

10.4 Enter into or takes steps to enter into a composition with Your creditors or You call a meeting of Your creditors;

11. If anything listed in clause 10 happens We may, after sending You a default notice:

11.1 Terminate this Agreement; and/or

11.2 Repossess the Bike, and under an order of the Court or with Your consent given at that time, enter any premises where the Bike is or is believed to be; and/or

11.3 Recover from You all costs and expenses incurred in repossessing, repairing, storing, and/or insuring the Bike

12. As well as Your other obligations under the Agreement, when the Agreement terminates You will, as soon as reasonably possible, return the Bike to the address which We will specify. 

13.  We warrant to You that the Bike We deliver will be in good working condition and suitable for a child of the correct age to ride off road.

14.  ­Any notice under this Agreement may be given by either party by delivery, by hand or by post at the other's address stated in this Agreement or its last known address and if sent by first-class post it shall be deemed to have been received at 9.00 am on the 2nd Business Day after posting.

15.  We may from time to time exercise discretion but that doesn’t affect Our rights under this Agreement. Any delay in enforcing Our rights under this Agreement, will not prevent Us from enforcing the Agreement.

16.  We may assign Our rights and transfer Our obligations under this Agreement by notice to You, but Your rights and obligations may not be transferred to any other person without Our prior written consent.

17.  This Agreement shall be interpreted in accordance with English law.
